I am an aboriginal American Man. Mi’kmaq and Cherokeee.I will be 45 in January.
Over 25 years ago I was convicted of two separate felonies. Receiving stolen property,
And Grand theft person. At the time I was willing to do anything to free myself from my
Alcoholic fathers cruel bonds. I went to prison and served my time. When I got out I
Traveled the country and worked and enjoyed my life and freedom. 13 years ago I got
Married and became a father. I had two daughters with my first wife. She died In Egypt
And I have since remarried and have two more biological children and three step children.
A few years ago I contacted the governor and asked about a pardon. I was told I could
Not receive one since I did not live in California. I was told instead ask for clemency. I
Tried several times to get the records from the county of Solano but they would never give me the numbers.
While living in our home in Mitchell South Dakota I received a visit from the BATF. Someone had told them I owned a pistol and was an ex felon. When they found out it was my mother in law who owned the guns and not me and that she kept them in a safe in her room they said that was fine and left. She inherited a house in Nebraska and we all moved here. It is a better place to raise kids but small so while she was looking for a home to buy in town she stayed with us as it was her house and land.
I am a retired tattooist but still work when I can and had done a few tattoos on a fellow for a jeep he had. He never delivered it and when I told his friends I was angry about it he
called the police and said I pulled a gun on him. Now I need to be very clear on this IT
NEVER HAPPENED! I have not to this day seen the guy again. No matter the cop who
is my wife’s uncle showed up with the sheriff and they arrested me. While I was in jail
they came to the house with a search warrant. They told my mother in law that if she
gave them a gun they would not tear the house up. She brought all her guns out and they
took an old Egyptian 9 mm pistol she had, and photographed all her collectable rifles.
then they went to a guy’s house a few miles away and told him they wanted a pistol he
had tried to trade my mother in law for tattoos. They have charged me with two counts of
Ex felon in possession of a firearm.
It has cost me several thousand dollars to hire a lawyer so far, and they are threatening to
send me to prison for 40 years.
I have rheumatoid arthritis, gout, and diabetes. I have nerve damage in both feet and legs.
I can only leave the property if I use a wheelchair. I am on oxygen for severe migraine
headaches.
Since we moved here over a year ago I have only left the property to go to the doctor or
to go to court. I have to take handfuls of pills every day for pain, and to keep the
swelling in my legs and joints down.
The only thing keeping me from ending my life is my wife and children. I love them
dearly and live each day trying to better their lives. I still tattoo when I can, Mostly for
trades. I am an ordained minister and have a number of friends who visit me for spiritual
guidance. I only recently found out about my Mi'kmaq and Cherokee ancestry. I have
lived most of my adult life on or near Indians and Indian reservations. I am married to a
Northern Ponca and Yankton Sioux woman who was raised traditional and has been
teaching me her traditional ways. I can say this much about myself, I am a good man, I
do not drink smoke or use illegal drugs. I believe in my Creator (Gisoolg in migmaw ,
Wakan Tanka in Sioux) and talk to him every day. I live according to a set of beliefs I
hold very dear. I learned from my mistakes. The time I spent in prison in California
although hard was one of the best learning experiences of my life (and not something I
need to repeat!) I have always told people I was a success story of the system. Now
because of my Past convictions I am facing a insane sentence for a victimless crime that
to myself and all who know me is a waste of time, and tax payers money. Not to mention
an extension of a sentence that basically commutes my past convictions to a lifelong
punishment.
I was told by my attorney it would be ok if my supporters sent Emails to the DA
expressing their feelings. Last week I was told he was and I quote "getting ********* about
all the Emails he was getting. I have been treated from the beginning of all this not as if I
was innocent but as if I am already convicted. I have been offered deal after deal to lower
the charges if I just admit to one charge. That is something I cannot do. I did nothing
wrong! I am no criminal!
